Abortion in Arizona set to be illegal in nearly all circumstances, state high court rules

The Arizona Supreme Court upheld a 160-year-old abortion ban that could shutter abortion clinics in the state.

The ruling indicated the ban can only be "prospectively enforced" and enforcement of the law is stayed for 14 days. But it's already causing political earthquakes.

The pre-statehood law mandates two to five years in prison for anyone aiding an abortion, except if the procedure is necessary to save the life of the mother. Enforcement would mean the end of legal abortions in Arizona. A law from the same era requiring at least a year in prison for a woman seeking an abortion was repealed in 2021.

Reproductive rights activists say it means Arizona women can expect potential health complications.

It's unclear just how, or if, the law will be enforced. Democratic Gov. Katie Hobbs issued an executive order last year giving all power to enforce abortion laws to the state attorney general. The current attorney general, Democrat Kris Mayes, has vowed not to enforce any abortion bans. But her decision and Hobbs' order could be challenged by one of the state's county attorneys.

One immediate effect could be the rise in popularity of a potential ballot measure in the works for this year. Advocates say they've already got more than 500,000 signatures, well above the threshold of 383,923 signatures needed by an early July deadline.

The state Supreme Court's ruling puts a stark choice before voters: Choose the new reproductive rights measure or watch abortion policy turn back to the 19th century.

That black-and-white choice, as well as an anticipated increase in turnout by Democrats because of the ballot measure, could also affect races in the state Legislature or other offices.

US Supreme Court ruling paved way for return of 1864 law

The abortion ban first codified in Arizona law in 1864 has been waiting 160 years to come back into effect.

First appearing in the 1864 Howell Code, a book of laws compiled by Arizona's First Territorial Legislature, the state's abortion ban was similar to those in many states. It was enforced vigorously in Arizona until the Roe v. Wade decision.

In 1971, Planned Parenthood of Tucson sued the state to overturn the old ban. The group lost the case in 1973 when the state Court of Appeals ruled against it. But the U.S. Supreme Court issued its historic Roe v. Wade decision the same year, causing the state Court of Appeals to issue an injunction against the pre-statehood ban.

For almost 50 years, legal abortions were considered a fact of American life, until the Dobbs v. Jackson Women's Health Organization ruling in June 2022 that removed the Roe protections.

The ruling by the new, more conservative U.S. Supreme Court spurred Republican politicians to ask the courts to lift the injunction from 1973 and allow police and prosecutors to enforce the 1864 law. The new court action had the effect of renewing Planned Parenthood's 1971 legal fight.

Fortunately they haven't built a wall preventing women from driving an hour or two and obtaining the services they need.
Even if they don't have a car. There is bus service to Calif. N. Mexico etc.

In shitty circumstances, kill your kid early on in the pregnancy.

Now, why they don't support more free contraception seems dumb.

But the pro abortionists (who oddly enough dont like being called that) are high on knowing they are right, and any deviation of that is the work of devil, or I guess Jesus (the left usually hates Jews anyways)

Our laws dont respect our body our choice for anything else.

Cant put certain substances in your body.

That all said, while I find late term abortion to be familialcide/ infanticide (sure go split hairs, your killing your kid early in development)

I may look down on you personally like I would most murderers , but not enough to really care much.

Simple solution is to abolish womens suffrage, it has been down hill since then.

In general, limiting the vote tends to lead toward better government IMHO.

Yes ... it's not your body and women aren't property of men or the state.

Odd that someone who feels like drug laws are an imposition can't understand why the government has no business forcing women to have babies that they don't want.

Some Republicans still are unaware of what happened in Kansas when they tried to put onerous laws regarding abortion in. Well of course they fucked up and put it on the ballot as a referendum. The women showed up at the polls and killed it.

For those that are aware of what happened the Republicans will do anything in their power to limit women from voting and won't put it on the ballot in referendum form.

It seems that even the Republican's representative from God (Donald Trump) has reversed himself again and now says leave it up to the individual States.

Body autonomy isn't practiced generally. Also, this process involves killing a human, who doesnt have body autonomy.

Also (murder) I can entirely understand it. Its the fact that I can go to jail for consuming drugs in public (or private) , the government can even kidnap children for drug use, but not for killing the previous offspring.

My point is that these can not co-exist in the se set of laws. I think most ppl wpuld agree killing a human is more severe than snorting a line, so logically, bodily autonomy cover drugs first, and killing 2nd.

But again, we have dumb laws, thay we may agree on.

Not just women, Ive long been in support of limiting the vote and not succumbing to mob rule.

Its a matter of quality over quantity.

Let me ask you this, if you seriously seen someone who beleived that hunter Biden was physically burning trump votes, and carrying mail sacks of biden votes all over the country, would you want them to be able to vote?

What benefit is gained by their suffrage?

I completely agree. A blood test with every vote, and anyone who tests positive has their vote annulled.

Habebe, I'm doing OK. Had a scare in Jan. Thought my time was up. Turned out I was way low on iron. They think is was a large pollop that they removed from my colon that was giving a slow bleed. Anyhow my iron is back up and I feel a hell of a lot better.

IMO on drugs? I think they all should be made available in a controlled way. If you chose to ingest or sample them, then you sign a waiver making you as an individual fully responsible for the outcome. Also that you fully are informed of the possible results of taking the drug of choice.

I feel the same about riding a motorcycle without a helmet. You and your family will be fully responsible for your care if you have an accident and suffer brain damage incapacitating you for the remainder of your life.

A question for anyone who screams about late term abortion. Is there any documented evidence of full term healthy babies being terminated by medical professionals?

PATom, My dad (71) was doong really bad, they said he was in final stages of kidney failure, now his older and two younger brothers have all passed on, just him and my aunt Deb left, but she insists on staying in her rental in PA, she cant drice anymore, but, We have too many cats as it is now, she wont move here without her cats (probably like 40 or something, I offered to pay and said why not bring 3 cats)

I don't want to end up so spread out like that generation did.

Ive made ALOT of headway on the property, going for a USDA loan in about a month ($50k) to rebuild it it.


Anyway, glad to hear from you. Im getting old myself, pushing 40.

Gonna go sell another couple comic books, my income has been primarily selling comics, legal plans, and sourcing books plus some odds and ends.

Got offered a job, work from home, $42k a yr to start plus incentives.

If I dont get a steadier income coming in Ive thought about it, but I jave a few things in the works .

We will see.

No, she wants to free the baby. With the GOP overturning child labor laws, the baby should have no trouble supporting itself.
