U.S. WILL RETURN AMERICAN ISIS FIGHTER TO SYRIA WITH DE FACTO ‘DEATH WARRANT’

The Trump administration is planning to release a suspected ISIS fighter in Syria with more than $4,000 in cash and a new cellphone, a Pentagon official said in a court filing released on Thursday.

The U.S. military has been holding the unidentified man, who is a Saudi-U.S. dual citizen, as a prisoner for about nine months.

Upon his release, the Petitioner will be given $4,210 in cash, the same amount he had in his possession when was captured,” the Pentagon official, Mark Mitchell, said in a declaration filed in U.S. District Court in Washington. “He will also be provided a new cellular phone (in its original sealed packaging), which he can activate and use if he desires to do so. He will be provided sufficient food and water to last for several days.”

The prisoner has rejected the release plan, Justice Department lawyers said. His attorneys at the American Civil Liberties Union are expected to file legal arguments later Thursday opposing the release.

The prisoner has rejected the release plan, Justice Department lawyers said. His attorneys at the American Civil Liberties Union are expected to file legal arguments later Thursday opposing the release.

“Instead of offering a safe release, they want to dump an American citizen onto the side of the road in a war-torn country without any assurances of protection and no identification,” Jonathan Hafetz, an ACLU lawyer, said in a statement on Wednesday.

Chutkan has tentatively set a hearing on the issue for 9 a.m. Friday. Officials said in a court filing on Wednesday that they would wait at least 72 hours before going forward with their plan, deferring to an order from Chutkan requiring three days’ advance notice of the transfer.

I see nothing wrong with the release. Let's face it, he was not arrested in Times Square.

"I see nothing wrong with the release."

They can't deport a US citizen unless some nation requests extradition.

"murder, he is not being deported. He is being released where he was arrested."

That's not the way release from custody works.

How does it work?

Do they fly him back to Iowa and turn him loose there?

Well the court is blocking his release in Iraq where he is now, so I'm assuming he's getting a plane ticket to the US.

Once the order to release comes in, the US government has no right to move him anywhere that he doesn't want to go.

Don't all US citizens have some pretty unalienable rights? It isn't a matter of smart/stupid, it's a matter of whatthefuckareyoudoingtomyrights??? You of all people, food, should very much understand the need to protect the basic rights of any american, no matter what border they stand accused of crossing illegally.

There are very few inalienable rights that apply to a terrorist caught with terrorists by a group fighting terrorists in a warzone created by terrorists.

How about ***THE RIGHT*** to suffer the consequences when you commit treason?

How about the right to a jury and judge if *anyone* suspects you have commited treason?

US citizens have the right to trial. Guy was being released anyway, so he again still has rights.

He is free to continue the activities that he was pursuing before he was picked up.

Sounds fairer than moving him back to America, presumably against his will.

"He is free to continue the activities that he was pursuing before he was picked up."

Has absolutely no relevancy. If the guy is being released from prison, there's a very standardized way of doing that:

- guy goes to desk clerk
- guy picks up belongings from desk clerk
- guy walks out front door
- guy is free to do as he pleases

Nowhere in this standard procedure is "get transported to a completely different country against your will."

You say that my statement, "He is free to continue the activities that he was pursuing before he was picked up." Is irrelevant.

Then you post step by step the meat of my statement. Thanks for agreeing.

All US citizens have rights. Or do you now support the stripping of rights of people never convicted of a crime?

He has not been accused of a crime evidently.

They are just going to give him his belongings and set him free.

But they're going to set him free in Syria, despite him currently being held in Iraq. They're going to quite literally kidnap a US citizen against his will and transport him somewhere.

Just let him walk out of the building, as per every fucking normal release from prison.

Then return him to Syria.

I believe that should be easy enough. Just drop him on the same corner where we picked him up.

No Hood, we just don't have sympathy nor see a need to make accommodations for a member of a terrorist network that has sworn to attack the United States. He is a terrorist who was caught in Syria, so we are dropping him off back in Syria.

Seriously, the guys is in fucking Iraq. What's the difference in him walking out the front door or being dropped off back in Syria (aside from, you know, the gross violation of rights)? It isn't like anyone (here) is suggesting we give him a first class flight back to the states, put him up in a nice hotel, and hand him ingredients to build a bomb.
