OKLAHOMA CITY — The attorney for a former state senator charged with producing and transporting child pornography says his client will plead guilty to one count of child sex trafficking in exchange for U.S. prosecutors dropping three other child pornography charges against him.

Ex-state Sen. Ralph Shortey’s attorney Ed Blau confirmed the details of the plea agreement to The Oklahoman on Friday. Blau told the newspaper Shortey wants to put the “painful and humiliating ordeal behind him.”

The 35-year-old married father of four resigned in March after being charged in state court with child prostitution after police say they found him in a hotel with a 17-year-old boy.

Shortey still faces between 10 years and life in prison if convicted of child sex trafficking.

Trump campaign chair
During the 2016 Republican presidential primaries, Shortey was an early endorser of Donald Trump, and served as a county coordinator for his campaign.

And you can't be more outraged than the victim who has accepted the apology and said that Sen. Franken should not resign and stated he is a good senator.

The implication was there mtard. You were attempting to morally make this equivalent. And as it was pointed out, kinda hard to do that, especially if the she only wanted an apology, which was given, and then turn around and expresses she doesn't think he should resign.

"simply pointing out the obvious fact that there are immoral politicians on the left."

And degree matters. You are comparing the immorality of Franken to that of Shortey to say that both sides are immoral. I'll gladly take some dude who takes jokes too far over someone who deals in child sex trafficking, any fucking day. I'll even say that comparatively, Franken is perfectly moral.

Kind of hard to see how "trafficking" applies when they met up after texting. Child prostitution applies just fine.

You should Read the Oklahoma statute for human trafficking, genius

Why would that be relevant? It's a federal charge, genius

My god. You are stupendously dense. Before I put you in your place again. I will state this for the obvious; then why would there be a state statute then it's already federally mandated? That is the simplistic answer for you.
Forwyn

Why are there state laws against murder when it's federally illegal?

Lol. Idiot.
Delude

The point is: because you are dense, is that state laws mimick federal laws. And in this particular instance; referenced the State law because well it would be the same because you needed a reference. Even in the federal statute, commercial sex, estastabled, sex trafficking, established.

Either or, both read the same.

So let us review:

Forseb logic: "Kind of hard to see how "trafficking" applies when they met up after texting. Child prostitution applies just fine."

Obvious answer: he was transported for commercial sex act purposes

Forseb logic: "The standard definition revolves around coercion, not juicing up a crime because the kid was picked up in a car, genius."

Facts: state and federal law: reference now is federal law: sex trafficking is the recruitment...[transportation]...[for th purposes of a commercial sex act, in which the commercial sex act is induced by force, fraud, or coercion, or which the person induced to perform such an act has not attained 18 years of age (22 USC 7102)

Conclusion: You are dumb.

So, I was remarking on the arbitrary nature of the law - I don't feel that the crime is suddenly worse because they drove in a car together, or if he paid for a taxi.

But since you want to be a whiney little bitch, let's follow your request for state law:

1. "Coercion" means compelling, forcing or intimidating a person to act by:

a.threats of harm or physical restraint against any person,

b.any act, scheme, plan, or pattern intended to cause a person to believe that performing, or failing to perform, an act would result in serious physical, financial, or emotional harm or distress to or physical restraint against any person,

c.the abuse or threatened abuse of the law or legal process,

d.knowingly destroying, concealing, removing, confiscating or possessing any actual or purported passport, labor or immigration document, or other government identification document, including but not limited to a driver license or birth certificate, of another person,

e.facilitating or controlling a person's access to any addictive or controlled substance other than for legal medical purposes,

f.blackmail,

g.demanding or claiming money, goods, or any other thing of value from or on behalf of a prostituted person where such demand or claim arises from or is directly related to the act of prostitution,

h.determining, dictating or setting the times at which another person will be available to engage in an act of prostitution with a third party,

i.determining, dictating or setting the places at which another person will be available for solicitation of, or to engage in, an act of prostitution with a third party, or

j.determining, dictating or setting the places at which another person will reside for purposes of making such person available to engage in an act of prostitution with a third party;

2. "Commercial sex" means any form of commercial sexual activity such as sexually explicit performances, prostitution, participation in the production of pornography, performance in a strip club, or exotic dancing or display;

3. "Debt bondage" means the status or condition of a debtor arising from a pledge by the debtor of his or her personal services or of those of a person under his or her control as a security for debt if the value of those services as reasonably assessed is not applied toward the liquidation of the debt or the length and nature of those services are not respectively limited and defined;

4. "Human trafficking" means modern-day slavery that includes, but is not limited to, extreme exploitation and the denial of freedom or liberty of an individual for purposes of deriving benefit from that individual's commercial sex act or labor;

5. "Human trafficking for labor" means:

a.recruiting, enticing, harboring, maintaining, transporting, providing or obtaining, by any means, another person through deception, force, fraud, threat or coercion or for purposes of engaging the person in labor, or

b.benefiting, financially or by receiving anything of value, from participation in a venture that has engaged in an act of trafficking for labor;

6. "Human trafficking for commercial sex" means:

a.recruiting, enticing, harboring, maintaining, transporting, providing or obtaining, by any means, another person through deception, force, fraud, threat or coercion for purposes of engaging the person in a commercial sex act,

b.recruiting, enticing, harboring, maintaining, transporting, providing, purchasing or obtaining, by any means, a minor for purposes of engaging the minor in a commercial sex act, or

c.benefiting, financially or by receiving anything of value, from participating in a venture that has engaged in an act of trafficking for commercial sex;

7. "Legal process" means the criminal law, the civil law, or the regulatory system of the federal government, any state, territory, district, commonwealth, or trust territory therein, and any foreign government or subdivision thereof and includes legal civil actions, criminal actions, and regulatory petitions or applications;

8. "Minor" means an individual under eighteen (18) years of age; and

9. "Victim" means a person against whom a violation of any provision of this section has been committed.

B. It shall be unlawful to knowingly engage in human trafficking.

Conclusion: Go fuck yourself.

Don't be mad at the law that was used. And that was a long diatribe of nothingness. And just Because of how you "feel" it's one thing when it explicitly states of how he was charged with the specific violation. And concerning he had other charges dropped just to have that specific one, should not be all that confusing since it does fit that criteria.

You are the one confused about how and why the application. Rest of us with comprehension skills sees why it made sense.

Conclusion: nanny nanny boo boo.

The legal definition doesn't require coersion. Simply by being under 18, transportation for a commercial sex act is trafficking.
Forwyn
Member

The state legal definition does. Federal (which shouldn't be applicable anyway), appears not to require it, though coercion creates an automatically more severe penalty.

"And that was a long diatribe of nothingness."

Nonsense. That's the law that you asked for.

From the State, from which you read.

"Human trafficking for commercial sex" means:

a.recruiting, enticing, harboring, maintaining, transporting, providing or obtaining, by any means, another person through deception, force, fraud, threat or coercion for purposes of engaging the person in a commercial sex act,

b.recruiting, enticing, harboring, maintaining, transporting, providing, purchasing or obtaining, by any means, a minor for purposes of engaging the minor in a commercial sex act, or

c.benefiting, financially or by receiving anything of value, from participating in a venture that has engaged in an act of trafficking for commercial sex;

Hmmmm, very similar.

But somehow, forseb is confused on "trafficking"

I'm sorry you're so incredibly butthurt about my observation about the arbitrary nature of applied trafficking statutes that you felt the need to educate yourself on the topic just to debate it.

""The standard definition revolves around coercion, not juicing up a crime because the kid was picked up in a car, genius.""

Actually, the standard definition, as pertaining to a minor, has no coercion criteria, even for state. See 6.b. from what you quoted. The case for a minor is any transportation. Fraud or coercion is unnecessary.
Forwyn

Mon Nov 20 18:41:06
Seems 6b is a catch-all then, as it doesn't even require transportation.

Hardly the laymen's definition of trafficking.

Yep. If you facilitate sex with a minor in any way, you can be nailed for trafficking. Doesn't seem unreasonable, considering how these things generally happen.

Well at least this discussion gave Hot Rod an important life lesson.

"When committing a sex crime against a child don't move them or you'll get an extra trafficing charge."

Should make it easy for police to arrest Hot Rod when he starts diddling the kid in public.

He'll get off scott free from the sex trafficing setnence.
