The Constitution requires the Senate to Advise and Consent to the Presidents nominations. This means the Senate has the right to reject approve a nomination (consent) or reject a nomination and explain why (advise). If they IGNORE a Presidential nomination (refuse to hold hearings), then they are in violation of the Constitution, and in violation of their constitutional duties. The President would have standing at this point to sue The Senate in Federal Court, setting up an unprecedented showdown between the three branches of Government. Because none of the three can constitutionally compel the other to carry out their duties. Even if the Constitution demands they do so. A big irony, but one that may be lost in the shouting. Because the Supreme Court could very well rule that the Senate MUST hold hearings on a Presidential nominee, and set a legal precedent of Presidential supremacy over Senate rules and procedures. The Senate could then accept that, or refuse to obey, setting a precedent for Congressional disobedience to the courts. Either outcome is bad, and both outcomes would damage Constitutional Law. But true to form, the Republicans in their lack of foresight are not thinking this through. |

You will hear a lot about Justice Kennedy being approved in an election year. But, let's not forget there were three nominees in 1987 before Kennedy was finally approved in Reagan's last year, 1988. The Senate is perfectly within their rights to stall the vote until next year. |

The President can do that you know. They've never done it before, largely because they would be guaranteed to lose a vote at that point. But Obama may do it just for the fireworks. |

Judge appointments are not extraordinary. Extraordinary would be something like Japan bombing Pearl Harbor. In short an extraordinary circumstance would be something that could not be correctly handled by a scheduled meeting of congress. Appointing a judge would not apply. |
