GOP will try to run out the clock, not confirming anyone Obama appoints. Another thing is, Obama is going to be president for about two weeks with a new Senate in session. If Dems have 50 seats after November, with Biden VP vote they can throw out filibuster rule completely and confirm a new justice during that time. So maybe GOP has to play ball a little.

In the face of the impending cluster fuck, we really should have 9 justices and 1-2 backups. In case a retarded congress has trouble doing its job or if a justice or two must recuse themselves.

Backups will only be used if one of the 9 main justices cannot perform their duty. In the case of stepping down, or more likely death, the first backup takes the vacated seat and a new backup is what becomes voted on.

Back on topic. Obama could choose to role the dice. Like CR said, the New Senate gets sworn in during a period where for 2 weeks Obama will still be President. He could very well make a go for the strong possibility the voters will return a Democrat controlled Senate, or at the very least a Democratic Presidency.

And if he loses the bet, its not like he really lost anything. We'd just be back at square one.

The Next congress, the 115th Congress, is sworn into service on January 3rd. The Next US President is sworn into service on January 21'st.

That means for a full 2 weeks, Obama will be Constitutionally the US President for the 115th Congress.

Furthermore, if the Democrats return a Majority in the US Senate for the 115th Congress, they can use the rules of a new session at the discretion of the President of the Senate (Vice President Biden) to suspend the filibuster and proceed to a floor vote on Obama's nominee by simply majority. Should the vote pass, then Obama's Supreme Court nominee would be granted his post.

This is huge for the Democrats. People won't just be electing a President, they will be electing a Supreme Court Justice, and that Supreme Court Justice will be voted by proxy via the Senate candidates who say they will support him/her.

No way in fucking hell Obama plays ball. The Dems are absolutely going to cast this as a Supreme Court Election at the Senate level, and a vote for or against the nominee will be the number 1 demand. And every voter will know whether or not their Senator choice supports or opposes said nominee.

Its a political wonks dream. Senate votes now matter massively. And every Senator will come under scrutiny.

Red States is subjective Garyd. The Senate is not, and cannot be Gerrymandered. Which means that even the reddest of States is no guarantee if the people in that State decide to buck the trend.

Take for example my own State of Virginia.

Our Congressional delegation to the house is Republican.

Our Legislature is Republican.

Our Governor, Attorney General, Lt. Governor and Both Senators are Democrats.

In Virginia, every political office subject to redistricting is dominated by the Republican Party. EVERY State office subject to state wide referendum is held by the Democrats.

He will have his nominee picked well in advance. They will then spend the next few months fighting over it. The Republicans will block every single time. Election happens, hopefully Democrats regain the Senate. Rule change invoked at the start of the new Senate term on January 3rd. Supreme Court nominee voted for on January 17th. Obama leaves office on the 21'st.

And their approval numbers are bad not because they stalled Obama but because they've scarcely bothered to try. His wife, Peggy Shippen Arnold came from a Tory family in Philadelphia and had much to do with Arnold's becoming a traitor.

They were married in the Shippen townhouse on Fourth Street on April 8, 1779. Not long after, Arnold began conspiring with the British to change sides. Peggy played a role in the conspiracy, which was exposed after British Major John André was arrested in September 1780 carrying documents concerning the planned surrender of the critical Continental Army base at West Point.

After Arnold's flight to New York City, Peggy Shippen Arnold followed. They traveled together to London at the end of 1781, where she established a splendid home as Arnold rebuilt a trading business. In 1787 she joined Arnold in Saint John, New Brunswick, where Arnold's difficulties with local businessmen eventually prompted their return to London in December 1791. He always had debt problems even before he met her and he always thought his military achievement were greater than what they really were. Washington himself never thought too much of him and when Arnold expressed an interest in commanding West Point he thought that would be a great way to get him out of the way.

I just finished reading all about him in 'George Washington's Secret Six: The Spy Ring That Saved the American Revolution.'



To show you what kind of a sleaze he was, he used Congress' money, which was always in short supply, to repair and provision the fort so it would be in top shape for the British.

Hell, he even wanted Washington to be at the fort when the British arrived to take it over so he could get credit for that too. That might even have ended the war right then.

As usual, stereotypes are usually only cursory. Having lived in both, I can safely say that a large city in the South or Midwest is much more likely to have a healthy balance between conservative and liberal principles than a large city on the coast.
