US man shoots dead German student, 17

A US homeowner who shot and killed a 17-year-old German high school exchange student from Hamburg whom he suspected of breaking into his garage was charged with homicide on Monday.

The 29-year-old shooter, Markus Kaarma was taken into custody on Sunday after Montana police found the victim with a gunshot wound to his head.

"Initial reports indicate that the male resident encountered an intruder in his garage after an alarm went off, and subsequently shot him with a shotgun," police sergeant Travis Welsh said.

Diren Dede was studying at Big Sky High School in Missoula on a year abroad where he played for the football team.

Kaarma appeared in court and was charged with deliberate homicide.

If convicted, he faces a minimum of 10 years and up to 100 years in state prison. Acting Justice of the Peace Suzanne Geer set bail at $30,000.

Defense lawyer Paul Ryan said Kaarma and his common law wife, Janelle Pflager, had been robbed twice in the previous three weeks and had installed screen surveillance and motion detectors. They have a 10-month-old son.

The two were on their couch, watching television, when an alarm sounded.

"They had no choice in their mind other than to confront the intruder," Ryan said.

Ryan said Kaarma felt terrible about killing Dede. "It wasn't his intent to even kill," he said. "It's really tragic, there's no question."

Dede's host family lived in the same neighborhood as Kaarma, according to Deputy County Attorney Andrew Paul.

Paul said Kaarma fired four distinct shots, covering the entire back wall of the garage with his shotgun.

"He was just shooting in the dark," Paul told AFP news agency. Paul wouldn't confirm that a second person had been with Dede on the night of the shooting, but noted that a friend had suggested the exchange student had entered the garage looking for something to drink.

Prosecutors accused the defendant of having a mindset of revenge. Paul cited a witness who alleges that Kaarma issued threats at a hairstyling salon on April 23. The hairstylist, Felene Sherbondy, quoted Kaarma as saying: "I'm just waiting to shoot some fucking kid," according to the prosecution's affidavit.

Missoula County Schools Superintendent Alex Apostle called the shooting a tragedy. "We are all pulling together to support the students, staff and families of Big Sky High School," he said.

The Council on International Educational Exchange, which organized Dede's stay, sent representatives to Montana, to meet with all parties and provide support. The student's family was also expected in Missoula in the coming days.

Ryan said he expected his client to plead not guilty at the preliminary hearing set for May 12.

He said he would invoke the so-called "Castle Doctrine," under which Montanans have the right to use deadly force to protect their homes if they feel threatened.

In 2012, Montana prosecutors decided not to charge a man who shot and killed another man in his garage.

Diren Dede killer convicted

Thirty-year-old Markus Kaarma has been convicted of deliberately killing a German exchange student in Montana. Kaarma had argued he shot the teenager in self defense during a home invasion.

Markus Kaarma (pictured above, center) was convicted of the deliberate homicide of 17-year-old German exchange student Dieren Dede of Hamburg on Wednesday, which carries a minimum penalty of ten years in prison. Kaarma, 30, had claimed self-defense´for shooting the unarmed teenager in his garage in a case which has highlighted a dubious “stand your ground” statute in Montana.

The case has been followed closely in Germany, with German authorities launching their own investigation into the killing.

Dede was most likely “garage hopping” - going through unlocked garages to look for alcohol - with a friend when he entered Kaarma's garage. The friend remained out on the street.

Kaarma, who the defense argued was overly anxious following a burglary in his garage shortly before, went after Dede with his shotgun 23 seconds after spotting him in the garage via a video feed. Kaarma's partner, Janelle Pflager, told the court last week that Kaarma did not attempt to help her as she went to assist Dede, who was bleeding "everywhere."

Dede died of his wounds in a Missoula hospital.

Revenge?

Kaarma's defense hinged on a controversial “stand your ground” law, which allows for the use of force if someone feels they are in imminent danger.

Prosecutor Karla Painter put the incident in a different light, saying Kaarma had deliberately tried to lure a teenager inside, so he could exact revenge for the previous burglary. He allegedly told neighbors he was going to harm the next person who tried to steal from his garage.

Painter said in her closing statement that Kaarma had created a trap by leaving his garage door partially open and rigging motion sensors, then going out the front door with his shot gun as soon as the sensors lit up.

After reviewing video evidence on Wednesday, jurors found Kaarma guilty.

"It is very good," said Dede's father, Celal Dede, with tears in his eyes. "Long live justice."
