An independent judiciary is critical. Almost as critical is avoiding the very appearance of impropriety.

I haven't followed Obamacare's judicial current events very closely, but IMO the threshold shouldn't be "can it be proven beyond a reasonable shadow of doubt that there is a conflict of interest?" but "could a reasonable person believe there may be a conflict of interest?"

So, based only on the information you provided MT, it sounds like a "yes".

I also think the individual mandate without a public option is folly.

For example, I do not believe any justice should recuse themselves on this ruling because it is unjust to believe any of the justices will not be able to put aside their personal beliefs/beliefs of their friends when deciding a case.
