Woman charged for having child ride in box atop van

ALBERTVILLE, AL - A Marshall County woman is in the city jail here for having her 13-year-old daughter ride in a cardboard box atop her van.

Albertville Police spokesman Sgt. Jamie Smith said Jackie Denise Knott, 37, of Albertville was charged with endangering the welfare of a child. Smith said the child was turned over to a relative.

Smith said police received a call Sunday morning of a minivan traveling on U.S. 431 with a large cardboard box on top with a child inside.

Officers stopped the van on U.S. 431 and asked Knott why the child was riding atop her vehicle.

"The box was too big to go inside the van, and she would be able to hold it down if she was inside the box," Smith said the woman told police.

When asked about the child's safety, Smith said Knott told the officers that she had the box secured to the van with a clothes hanger.

There are bad drivers. People go too fast; merge without signaling; talk, text, eat, do makeup, get dressed, etc. while driving in busy traffic. All that needs to happen is a loss of license after that cause of accident was found.

Fred, you can be arrested for breaking any law. That does not mean they do. If you are arrested, you are held until your court date at which point you can be sentenced. If the sentence is a 150 dollar fine, you pay the fine and are released.

The reason they don't do that is because it aggravates people and is too expensive to arrest everyone who does not wear a seat belt.

Dude, the whole point of granting power of arrest is they can hold you when you commit a crime.

At the point of arrest, you are to be immediately arraigned by a local magistrate if they want to hold you for a time (varies by jurisidiction, nobody is uniform; generally 24-48 hours). At the arraignment hearing you can ask to be free until your court date or post bail. For a small misdemeanor, the Judge would probably tell the police to lay off and let the guy go until trial.

Right, it is not required fuckhead, as it the police officer does NOT have to make an arrest, however, he has the legal authority to do so. The cop can use his discretion. I posted for you a link specificy an incident where it is allowed to arrest for such minor offenses.
